The present paper seeks, from the political realism of Hinkelammert and the politics of the liberation of Dussel, to identify the initial limits that delineate the framework of political action. The political action framework delimits the space of empirical possibility. For it, the definition of politics is adopted as “art of the possible”, explicitly accepted by Hinkelammert and developed implicitly by Dussel. Three limits are identified that outline the framework of political action: 1) the natural environment as a condition of (...) existence of living corporality, 2) the satisfaction of physical needs as a condition to preserve living corporality, 3) intersubjective experiences as a condition to maintain the human life. Propose these limits allows to establish the bases of the utopia of the political realism of Hinkelammert and of the politics of the liberation of Dussel. (shrink)

This volume brings together Nussbaum's published papers on the relationship between literature and philosophy, especially moral philosophy. The papers, many of them previously inaccessible to non-specialist readers, deal with such fundamental issues as the relationship between style and content in the exploration of ethical issues; the nature of ethical attention and ethical knowledge and their relationship to written forms and styles; and the role of the emotions in deliberation and self-knowledge. Nussbaum investigates and defends a conception of ethical understanding which (...) involves emotional as well as intellectual activity, and which gives a certain type of priority to the perception of particular people and situations rather than to abstract rules. She argues that this ethical conception cannot be completely and appropriately stated without turning to forms of writing usually considered literary rather than philosophical. It is consequently necessary to broaden our conception of moral philosophy in order to include these forms. Featuring two new essays and revised versions of several previously published essays, this collection attempts to articulate the relationship, within such a broader ethical inquiry, between literary and more abstractly theoretical elements. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. When cognitive neuropsychologists make inferences about the functional architecture of the normal mind from selective cognitive impairments they generally assume that the effects of brain damage are local, that is, that the nondamaged components of the architecture continue to function as they did before the damage. This assumption follows from the view that the components of the functional architecture are modular, in the sense of being informationally encapsulated. In this target article it is argued that this “locality” assumption is probably (...) not correct in general. Inferences about the functional architecture can nevertheless be made from neuropsychological data with an alternative set of assumptions, according to which human information processing is graded, distributed, and interactive. These claims are supported by three examples of neuropsychological dissociations and a comparison of the inferences obtained from these impairments with and without the locality assumption. The three dissociations are: selective impairments in knowledge of living things, disengagment of visual attention, and overt face recognition. In all three cases, the neuropsychological phenomena lead to more plausible inferences about the normal functional architecture when the locality assumption is abandoned. Also discussed are the relations between the locality assumption in neuropsychology and broader issues, including Fodor's modularity hypothesis and the choice between top-down and bottom-up research approaches. However, following on from the idea that artistic value is (...) broader than aesthetic value, the last 15 years has seen an explosion of interest in exploring possible inter‐relations between the appreciative and ethical character of works as art. Consideration of these issues has a distinguished philosophical history but as the Compass survey article suggests (‘Art, Morality and Ethics: On the (Im)Moral Character of Art Works and Inter‐Relations to Artistic Value.’Philosophy Compass 1.2 (2006): 129–43), it is only very recently that figures in the field have returned to it to develop more precisely what they take the relationships to be and why. Consensus is, unsurprisingly, lacking. The reinvigoration of the issues has led sophisticated formalists or autonomists to mount a more considered defence of the idea that aesthetic and literary values are indeed conceptually distinct from the justification or otherwise of the moral perspective or views endorsed in a work (Topic I). The challenges presented by such a defence are many but amongst them are appeals to critical practice (Lamarque and Olsen), scepticism about whether or not art really can give us bona fide knowledge (Stolnitz) and the recognition that truth often seems to be far removed from what it is we value in our appreciation of works (Lamarque). One way to motivate consideration of the relevance of a work’s moral character to its artistic value concerns the phenomena of imaginative resistance. At least sometimes it would seem that, as Hume originally suggested, we either cannot or will not enter imaginatively into the perspective solicited by a work due to its morally problematic character (Topic II). In some cases, it would seem that as a matter of psychological fact, we cannot do so since it is impossible for us to imagine how it could be that a certain attitude or action is morally permissible or good (Walton). The question then is whether or not this is a function of morality in particular or constraints on imaginative possibility more generally and what else is involved. At other times, the phenomena seem to be driven by a moral reluctance to allow ourselves to enter into the dramatic perspective involved (Moran) or evaluation of the attitude expressed (Stokes). Nonetheless, it is far from obvious that this is so of all the attitudes or responses we judge to be morally problematic. After all, it looks like we can and indeed often do suspend or background particular cognitive and moral commitments in engaging with all sorts of works (Nichols and Weinberg). If the moral character of a work interacts with how we appreciate and evaluate them, then the pressing question is this: is there any systematic account of the relationship available to us? One way is to consider the relationship between our emotional responses to works and their moral character (Topic III). After all, art works often solicit various emotional responses from us to follow the work and make use of moral concepts in so doing (Carroll). Indeed, whether or not a work merits the sought for emotional responses often seems to be internally related to ethical considerations (Gaut). Yet, it is not obvious that we should apply our moral concepts or respond emotionally in our imaginative engagement with works as art as we should in real life (Kieran, Jacobson). A different route is via the thought that art can convey knowledge (Topic IV). There might be particular kinds of moral knowledge art distinctively suited to conveying (Nussbaum) or it may just be that art does so particularly effectively (Carroll, Gaut, Kieran). Either way where this can be tied to the artistic means and appreciation of a work it would seem that to cultivate moral understanding contributes to the value of a work and to betray misunderstanding is a defect. Without denying the relevance of the moral character of a work some authors have wanted to claim that sometimes the immoral aspect of a work can contribute to rather than lessen its artistic value (Topic V). One route is to claim that there is no systematic theoretical account of the relationship available and what the right thing to say is depends on the particular case involved (Jacobson). Another involves the claim that this is so when the defect connects up in an appropriate way to one of the values of art. Thus, it has been claimed, only where a work reveals something which adds to intelligibility, knowledge or understanding in virtue of its morally problematic aspect can this be so (Kieran). The latter position looks like it could in principle be held whilst nonetheless maintaining that the typical or standard relationship is as the moralists would have it. Yet perhaps allowing valence change for such reasons is less a mark of principled explanation and more a function of downright inconsistency or incoherence (Harold). Personhood is a foundational concept in ethics, yet defining criteria have been elusive. In this article we summarize attempts to define personhood in psychological and neurological terms and conclude that none manage to be both specific and non-arbitrary. We propose that this is because the concept does not correspond to any real category of objects in the world. Rather, it is the product of an evolved brain system that develops innately and projects itself automatically and irrepressibly onto the world whenever (...) triggered by stimulus features such as a human-like face, body, or contingent patterns of behavior. We review the evidence for the existence of an autonomous person network in the brain and discuss its implications for the field of ethics and for the implicit morality of everyday behavior. We present a model for several early stages of the sensorimotor transformations involved in targeted arm movement. In psychophysical experiments, human subjects pointed to the remembered locations of randomly placed targets in three-dimensional space. They made consistent errors in distance, and from these errors stages in the sensorimotor transformation were deduced. When subjects attempted to move the right index finger to a virtual target they consistently undershot the distance of the more distal targets. Other experiments indicated that the error was (...) in the sensorimotor transformation rather than in the perception of distance. The error was most consistent when evaluated using a spherical coordinate system based at the right shoulder, indicating that the neural representation of target parameters is transformed from a retinocentric representation to a shoulder-centered representation. According to the model, the error in distance results from the neural implementation of a linear approximation in the algorithm to transform shoulder-centered target parameters into a set of arm orientations appropriate for placing the finger on the target. The transformation to final arm orientations places visually derived information into a frame of reference where it can readily be combined with kinesthetically derived information about initial arm orientations. The combination of these representations of initial and final arm orientations could give rise to the representation of movement direction recorded in the motor cortex by Georgopoulos and his colleagues. Later stages, such as the transformation from kinematic to dynamic parameters, or to levels of muscle activation, are beyond the scope of the present model. (shrink)

And what might I have offered those involved if they had called an ethics consult at the time? One of this physician's implicit questions was, “How might this have unfolded in a better way?”When difficult choices must be made, how can a narrative approach help? A narrativist focuses less on principles, rules, and law than would a (...) philosopher or a lawyer. This is not to say that we ignore the law or are unaware of bioethical principles. But where do we go from there? Narrative offers a mode of engagement that asks different kinds of questions than those that law or philosophy might ask about moral agency, context, and values. ObjectiveTo examine measurement agreement between a vocabulary test that is administered in the standardized manner and a version that is administered with a brain-computer interface.MethodThe sample was comprised of 21 participants, ages 9–27, mean age 16.7 years, 61.9% male, including 10 with congenital spastic cerebral palsy, and 11 comparison peers. Participants completed both standard and BCI-facilitated alternate versions of the Peabody Picture Vocabulary Test - 4. The BCI-facilitated PPVT-4 uses items identical to the unmodified PPVT-4, but each quadrant forced-choice item (...) is presented on a computer screen for use with the BCI.ResultsMeasurement agreement between instruments was excellent, including an intra-class correlation coefficient of 0.98, and Bland-Altman plots and tests indicating adequate limits of agreement and no systematic test version bias. The mean standard score difference between test versions was 2.0 points.ConclusionThese results demonstrate that BCI-facilitated quadrant forced-choice vocabulary testing has the potential to measure aspects of language without requiring any overt physical or communicative response. Thus, it may be possible to identify the language capabilities and needs of many individuals who have not had access to standardized clinical and research instruments. (shrink)

Human beings are both needy and dignified. How should we think about the relationship between our neediness and our worth? Card argues well that our vulnerability to luck is intertwined in the very conditions of moral agency. We can see the merit of her approach even more clearly by turning to some difficulties the Stoics have in preserving dignity while removing vulnerability. Stoicism does, however, help us to sort through the difficulties involved as we try to combine love of particular (...) people with respect for all human life. Richardson is correct to suggest that love itself can animate the concern for all humanity; I also agree with him that institutions must play a major role in any solution to problems of inequality between nations. Although the “capabilities approach” offers an attractive account of one part of the goal of just political institutions, combining, as Moody‐Adams suggests, respect for difference with a commitment to universal norms, I now believe that the capabilities account should be combined with a form of Rawlsian political liberalism that protects spaces within which citizens may pursue the good as they understand it. Using the bench trial of Colorado’s Amendment 2 as an example, this article focuses on the more general question of expert testimony in moral philosophy. It argues that there is indeed expertise in moral philosophy but argues against admitting such expert testimony in cases dealing with what John Rawls terms “constitutional essentials” and ‘matters of basic justice.” Developing the idea of public reason inherent in the Rawlsian concept of political liberalism, the article argues that philosophers can and should speak out (...) on public issues, if they do so with due respect for certain restrictions, but that they should not serve as expert witnesses on core constitutional questions, since doing so suggests that they claim a type of authority that would require fellow citizens to defer to their views. Such claims to authority in basic ethical matters threaten the mutual respect for divergent comprehensive doctrines that lies at the core of political liberalism. Philosophers have a duty to serve the public good, and they perform this service in fruitful ways. But they should refuse a public role that appears incompatible with equal respect for the committed ethical searching of their fellow citizens. (shrink)

This article discusses three main orientations in recent works of legal and political theory about the family-contract-based, community-based, and rights-based-and argues that none of these takes adequate account of two paradoxical features of family life and of the family's relationship to the state. A coherent political and legal theory of the family in the contemporary United States requires recognition of the relational rights and responsibilities intrinsic to family life.

Since the mid‐1980s, psychologists and neuroscientists have used brain imaging to test hypotheses about human thought processes and their neural instantiation. In just three decades, functional neuroimaging has been transformed from a crude clinical tool to a widely used research method for understanding the human brain and mind. Such rapidly achieved success is bound to evoke skepticism. A degree of skepticism toward new methods and ideas is both inevitable and useful in any field. It is especially valuable in a science (...) as young as cognitive neuroscience and its even younger siblings, social and affective neuroscience. Healthy skepticism encourages us to check our assumptions, recognize the limitations of our methods, and proceed thoughtfully. Skepticism itself, however, also must be examined.In this article, I review the most commonly voiced criticisms of functional neuroimaging. In the spirit of healthy skepticism, I will critically examine these criticisms themselves. Each contains at least a kernel of truth, although I will argue that in some cases the kernel has been overextended in ways that are inaccurate or misleading. (shrink)

Reasons for the limited uptake of the clinician–scientist role within nursing are examined, specifically: the lack of consensus about the nature of nursing science; the varying approaches to epistemology; and the influence of post-modern thought on knowledge development in nursing. It is suggested that under-development of this role may be remedied by achieving agreement that science is a necessary, worthy pursuit for nursing, and that rigorous science conducted from a clinical perspective serves nursing well. Straddling practice and research is a (...) powerful strategy for ensuring relevant research while forging strong links with practice. The clinician–scientist role, typically requiring a 75:25 ratio between research and clinical activities, is well established in medicine. Nursing, however, has been slow to institute the role; it is rare within North America, Australia, and western European countries, and almost non-existent outside those areas. Beyond structural obstacles, philosophical issues may explain nursing's reluctance to implement the role. Following a survey of clinician–scientist roles throughout the world, the nature of nursing science and epistemology, and the influence of post-modern thought on nursing attitudes to research are examined with respect to their influence on this role. The nurse clinician–scientist role holds promise for making strides in clinically relevant research, and for accelerating the knowledge cycle from clinical problem to research question to change in clinical practice. Recent studies reveal that violence significantly contributes to explaining individual’s facial preferences. Women who feel at higher risk of violence prefer less-masculine male faces. Given the importance of violence, we explore its influence on people’s preferences for a different physical trait. Masculinity correlates positively with male strength and weight or body mass index. In fact, masculinity and BMI tend to load on the same component of trait perception. Therefore we predicted that individuals’ perceptions of danger from violence will relate to (...) preferences for facial cues to low-BMI. In two studies in Colombia, men and women from Bogota, Medellin, and surrounding communities were shown pairs of faces transformed to epitomize the shape correlates of men with high or low-BMI. The images were of European, Salvadoran, or Colombian men. Participants were asked to choose the face they considered most attractive. Subsequently, participants answered a survey about their health, media access, education level, and experiences/perceptions of violence in study 1 and about specific types of violence in study 2. Results from both studies showed that women who experienced/perceived higher levels of violence preferred faces of low-BMI Salvadoran men. Preferences for low-BMI facial cues were significantly explained by violence, even after controlling for all other variables. These results may reflect women’s strategy to avoid male partners capable of inflicting harm. (shrink)

Using data collected from 280 full-time employees from a variety of organizations, this study examined the effects of employee perceptions of the behavioral integrity (BI) of their supervisors on job tension. The moderating effect of procedural justice (PJ) on this relationship also was examined. Substitutes for leadership theory (Kerr and Jermier, 1978) and psychological contract theory (Rousseau, Empl Responsib Rights J 2:121–139, 1989) were used as the theoretical foundations for the hypothesized relationships. Results indicated a negative relationship between BI and (...) job tension. PJ moderated this relationship such that it was weakened under conditions of high PJ. The analogies between religious and secular juridical arguments interest political theorists because they suggest a hidden link between religion and politics. However, merely describing analogies does not show that the link is significant. Why are there such analogies? The question matters because answering is a prerequisite for determining whether there can be a neutral political background to religion. This paper argues that there are such analogies because arguments in theology and arguments in the juridical theory of the state share a (...) common structure. This structure is such that the meaning of some concepts in the theory of the state, like political order and sovereignty, cannot be fully understood without reference to theological concepts. This thesis – political theology – has become associated with Carl Schmitt, but the argument in this paper differs importantly from his. Unlike Schmitt, this paper claims that in the contemporary state political theology can be superseded. (shrink)

Hospital ehtics committees are often consulted when cmopeting patient interests blur an otherwise clear course of medical treatment. Nowhere is the potential for competing interests greater than in the field of abosterics, wherer obstetricians have traditionally viewed themselves as having two patients: the pregnant woman and the fetus.

Two experiments were conducted to test a prediction of the Kosslyn & Shwartz computer simulation model of mental image processing. According to this model, more complex images require more time to form because parts are placed sequentially, and larger images require more time to form than smaller ones because more parts are placed. If these accounts are correct, then the advantage of forming a small image (i.e., one that seems to subtend a smaller visual angle) should be greater for more (...) complex objects because the difference in number of parts imaged at the two sizes will be greater than with simpler objects. This prediction was confirmed only when subjects were not motivated to form highly elaborated images at small sizes. When subject tried to include all details, it actually took longest to form images of complex objects at small sizes. Both of these results support the central assumption of the Kosslyn‐Shwartz model, namely the existence of a fixed resolution analog spatial medium. (shrink)

Jerry Fodor has proposed a causal theory of meaning based on the notion of a certain asymmetric dependency between the causes of a symbol's tokens. This theory is held to be an improvement on Dennis Stampe's causal theory of meaning and Fred Dretske's information theoretic account, because it allegedly solves what Fodor calls the “disjunction problem”, and does so without recourse to the kind of optimal (ideal) conditions to which Stampe and Dretske appeal. A series of counterexamples is proposed to (...) Fodor's account, which, it is argued, can only be met by reintroducing that same appeal to optimal conditions that he had sought to eliminate. It is then argued that Fodor's notion of asymmetric dependence is not fundamental to the explanation of why a symbol means what it does: on the contrary, the symbol's meaning what it does is explanatorily prior to the obtaining of the asymmetry, so the asymmetry cannot be used to explain the symbol's meaning. Finally, it is argued that the “disjunction problem “ as it is defined by Fodor is not a genuine problem for causal theories of meaning. (shrink)

Personhood is a foundational concept in ethics, yet defining criteria have been elusive. In this article we summarize attempts to define personhood in psychological and neurological terms and conclude that none manage to be both specific and non-arbitrary. We propose that this is because the concept does not correspond to any real category of objects in the world. Rather, it is the product of an evolved brain system that develops innately and projects itself automatically and irrepressibly onto the world whenever (...) triggered by stimulus features such as a human-like face, body, or contingent patterns of behavior. We review the evidence for the existence of an autonomous person network in the brain and discuss its implications for the field of ethics and for the implicit morality of everyday behavior. Rereading a canonic book in medical humanities can generate an immediate sense of how much has changed in the larger conversations still circulating around the issues that book broached in significant ways. The appearance in 2013 of the second edition of Arthur Frank's The Wounded Storyteller, first published in 1995, prompted me to review what has happened in the field of body studies in the intervening decades. Some developments point to the continuing importance of Frank's book, and others raise productive (...) questions about its limitations. (shrink)

Actualmente, somos integrantes de la Red de Educadores Matemáticos Críticos (REDUMAC) y encontramos relevante, estudiar los caminos transitados, los desafíos que hemos asumido con la intención de transformar las prácticas matemáticas desde la escuela, así como hacer evidente las posibilidades de nuestra apuesta teórica, metodológica y las formas de trabajo como colectivo de maestros. Este colectivo surge del interés y preocupación de profesionales en educación por continuar la formación que habíamos puesto en marcha desde el desarrollo de nuestros trabajos de (...) grado de maestría bajo perspectivas sociopolíticas y de la política cultural de la educación matemática retomando inicialmente postulados de la Educación Matemática Crítica (EMC). El desarrollo de las prácticas pedagógicas propuestas que hemos gestado ha girado en torno al diseño de escenarios de aprendizaje y de ambientes de modelación matemática. Sustentados en estas ideas teóricas, REDUMAC busca generar espacios desde los cuales los profesores continuemos profundizando y reflexionando las ideas que trabajamos en nuestras investigaciones, encontrando intereses comunes con otros compañeros. De esta manera, buscamos posicionarnos y actuar críticamente en nuestro rol como profesores e investigadores desde el campo de la educación matemática para pensar y reflexionar sobre las problemáticas que vinculan la escuela, la universidad y la sociedad. Nuestro objetivo es continuar consolidándonos como red y como espacio de formación continuada de profesores, desde un proceso autónomo que surge de los propios intereses de sus participantes, y que quiere vincular a más profesores e investigadores del país que tengan esas mismas intencionalidades. Con este escrito, buscamos no solo invitar a la comunidad a poner en discusión esta preocupación, sino dar a conocer la experiencia en formación continuada de profesores de matemáticas que hemos venido explorando, construyendo y consolidando desde espacios de autoformación. Para lograrlo, hacemos un proceso reflexivo y de autoconocimiento para identificar los caminos que hemos transitado, las posibilidades y los retos que venimos asumiendo desde nuestro trabajo colaborativo, buscando otros mundos posibles que vinculen la educación matemática y la realidad social de nuestro país. De esta manera, iniciamos el artículo con un apartado en el cual argumentamos la relevancia de retomar el camino de REDUMAC, posteriormente, reconstruimos en detalle nuestra historia, y en un tercer apartado, profundizamos en las estrategias de trabajo que hacen particular a este colectivo de maestros. Para finalizar, relatamos los caminos recorridos, los logros alcanzados, los aprendizajes construidos, las posibilidades que encontramos a futuro para nuestro colectivo y para iniciativas que se puedan gestar en estas líneas.
